ProLaunchKit Terms & Conditions

These Terms and Conditions govern the purchase and use of ProLaunchKit, operated by COLORS Design. By purchasing or using ProLaunchKit, you agree to these Terms.

Our Refund Policy and Privacy Policy also apply to your purchase and use of ProLaunchKit.

ProLaunchKit is a streamlined, productized website launch service for growing businesses. The core launch currently includes:

• A professional website: up to 5 pages on the Launch plan, or up to 10 pages at launch on the Plus plan
• Structured layout and formatting
• Website design and implementation
• Launch logo (a wordmark using your business name)
• Favicon
• A matching profile image for social accounts
• Email signature
• Local-search setup
• Website launch support
• Delivery within the stated timeline

Website hosting is provided through an active care plan. See Section 7.

Separately priced work

The following are not included in the setup fee or in a care plan and are charged separately when requested:

• Additional pages beyond the amount included with your plan
• Website update batches beyond any included with your plan
• Other work quoted and agreed in writing before it begins

Not included

ProLaunchKit is a productized service and does not include the following. Where a project requires them, ProLaunchKit may not be the right fit:

• Fully bespoke or custom website design
• Custom software or application development
• Complex or custom-built integrations
• Full e-commerce stores, including product catalogs, inventory, shipping, variants, or customer accounts
• Large or enterprise websites
• Full brand strategy
• Domain purchase or registration
• Advertising management
• Ongoing or advanced SEO campaigns
• Unlimited revisions or unlimited ongoing design work
• Services outside the agreed project scope

You are responsible for:

• Submitting accurate and complete information
• Completing the required intake
• Providing required content and assets
• Providing timely feedback
• Maintaining ownership and access to your domain account
• Following the provided domain connection instructions
• Completing any verification steps that must legally or technically be performed by the account owner

Domain connection

You are responsible for connecting your domain to your ProLaunchKit website using the instructions we provide. ProLaunchKit provides a step-by-step connection guide and reasonable support if you need assistance during the process.

Hosting

Website hosting is provided by ProLaunchKit through your care plan. An active care plan is required for ProLaunchKit to continue hosting and maintaining the website.

Payments are processed through Stripe and are subject to our Refund Policy. Payments are processed securely through third-party payment providers. ProLaunchKit does not store full credit card information.

• Website setup fee: $499 standard, currently offered at a $149 launch special
• Launch care plan: $25/month, or $250/year paid annually
• Plus care plan: $49/month, or $490/year paid annually
• Additional pages: $99 per page
• Website update batch on Launch: $59 per batch
• Additional update batch on Plus within the same billing month: $49

The setup fee and the first period of your care plan are charged at checkout. The care plan then renews automatically on the cycle you selected until cancelled.

Annual plans are paid upfront for the full term. Current pricing is shown on the ProLaunchKit website and at checkout, and applies to your purchase as displayed at the time of purchase.

• Standard delivery: 7 business days
• The timeline begins after payment confirmation and completed intake
• Client delays can extend delivery

• The first 30 days after launch include revisions to the website originally built for you
• Launch revisions are for finalizing that original scope and are not unlimited redesigns, unlimited pages, or unlimited functionality
• After the first 30 days, changes are handled as website update batches, priced as set out in Section 4
• Structural changes, new pages, major new features, or a new creative direction may be outside scope and quoted separately

Every ProLaunchKit website continues on a care plan. Both plans include:

• Website hosting
• SSL
• Daily backups
• Security and uptime monitoring
• Domain connection and go-live support
• Ongoing website maintenance
• ProLaunchKit support

Launch

$25/month or $250/year. Website update batches are available at $59 per batch and are not included in the plan.

Plus

$49/month or $490/year. Includes everything in Launch, plus up to 10 pages at launch, one done-for-you website update batch each billing month, and priority handling of update requests.

One update batch is included per billing month. Unused update batches do not roll over or accumulate, including on annual plans. An annual plan provides one included batch per month, not a balance of twelve.

Cancellation

An active care plan is required for ProLaunchKit to continue hosting and maintaining the website. You may cancel future renewal at any time. On cancellation:

• Monthly plans remain active through the end of the current paid billing period and do not renew
• Annual plans remain active through the end of the paid annual term and do not renew. Annual payments are not refunded on cancellation
• Ongoing ProLaunchKit support and hosting end when the paid period ends
• You retain ownership of your domain and your original content

If required materials, feedback, approvals, or communication are not received for 40 consecutive calendar days, ProLaunchKit may close the project due to inactivity after making reasonable attempts to contact you. When a project is closed for inactivity:

• Work completed up to that point may be delivered as-is
• Additional revisions are not automatically included
• Restarting a closed project may require a new purchase or additional fee

Refund eligibility is governed by our Refund Policy.

You retain ownership of the content you provide. ProLaunchKit and COLORS retain ownership of our proprietary systems, workflows, frameworks, processes, and internal methodologies.

Ownership and usage rights for refunded creative work are governed by our Refund Policy.

ProLaunchKit may request permission to showcase completed projects. Client work is not publicly displayed without prior approval.

ProLaunchKit is not responsible for outages or failures involving hosting infrastructure, payment providers, domain providers, or other third-party services outside ProLaunchKit’s reasonable control, including Stripe.

ProLaunchKit is also not responsible for:

• Business performance
• Revenue outcomes
• Client modifications
• Third-party integrations outside scope
• Third-party service failures outside reasonable control

These Terms are governed by the laws of the State of Michigan, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or to your purchase or use of ProLaunchKit will be subject to the exclusive jurisdiction of the state and federal courts located in the State of Michigan.
